This Acceptable Use Policy (“Policy”) governs the use of services provided by Viral Coach, LLC (“Viral Coach,” “we,” or “us”) to all users (“User,” “you,” or “your”). By accessing or using our Services you agree to comply with this Policy, which is incorporated into the Master Terms of Service (www.viralcoach.com/terms) (“Terms”). Violations may result in suspension or termination of access.
1. Scope
This Policy applies to all Services offered by Viral Coach, including software, applications, content, communication channels, the Skool community and staffing services. The Policy sets forth acceptable and prohibited uses to ensure our Services are used in a legal, ethical and secure manner.
2. Prohibited Activities
Users must not engage in any activity that:
Violates Law. Uses the Services for any unlawful purpose or in a way that violates applicable local, state, national or international laws and regulations.
Introducing Malware. Distributes viruses, Trojan horses, worms, bots or other malicious software.
Spam or Unsolicited Communications. Sends unsolicited communications or spam through or to the Service.
Defames or Harasses. Publishes or shares defamatory, obscene, hateful, abusive, harassing, violent or inflammatory material.
Impersonates Others. Impersonates any person or entity, including Viral Coach, its staff or other Users, or falsely states or misrepresents an affiliation.
Violates Privacy or IP. Infringes upon the privacy, publicity or intellectual‑property rights of others.
Interferes with Operations. Attempts to gain unauthorized access to accounts, systems or networks; disrupts or interferes with the integrity or performance of the Services or any data contained therein.
This list of prohibited activities is not exhaustive. Viral Coach reserves the right to determine whether an activity is unacceptable and to take appropriate action.
3. User Obligations
Users are responsible for their conduct and the content they transmit. You agree to:
Use Services Legally. Use the Services only for lawful purposes and in compliance with all applicable laws and regulations, including advertising, telemarketing and privacy laws.
Safeguard Access. Maintain the security of your account credentials and promptly notify Viral Coach of any unauthorized use or security breach.
Respect Rights. Respect the intellectual‑property and publicity rights of others; do not upload content without proper authorization.
Provide Accurate Information. Provide accurate information when creating accounts, posting content or communicating with Viral Coach.
4. Compliance with Laws & Regulatory Obligations
Users are responsible for complying with all applicable laws and regulations, including laws governing deceptive and misleading advertising, CAN‑SPAM, telemarketing, the TCPA, the FTC’s Revised Endorsements and Testimonials Guides, data‑protection laws (GDPR/CCPA/UK GDPR), and import/export regulations. Users must comply with court orders and government requests regarding user data.
5. Enforcement
Upon any breach of this Policy, Viral Coach reserves the right to take any enforcement action deemed appropriate. Actions may include issuing warnings, suspending or terminating services, removing or modifying content, reporting violations to law enforcement and initiating legal action. Viral Coach’s choice to not enforce a provision does not waive its right to enforce it later. Users are encouraged to report violations or misuse to support@viralcoach.com.
6. Amendments
Viral Coach may amend this Policy at any time. Updates will be posted on our website and are effective upon posting. Continued use of the Services after any such changes constitutes acceptance of the revised Policy.
7. Limitation of Liability
To the fullest extent permitted by law, Viral Coach shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages resulting from violations of this Policy or the inability to use the Services. Nothing in this Policy limits liability that cannot be limited under applicable law.
